Samos Trial Monitoring 19 October 2026
| October 23, 2026 | Trial Monitoring |
Greek translation below
On 19 October 2026, a trial observer from I Have Rights (IHR), a member organisation of the Border Violence Monitoring Network (BVMN), attended three first instance hearings before the Single-Member Court of Appeals of the Aegean in Samos.
The trial observer was present to assess compliance with Article 6 of the European Convention on Human Rights (ECHR) and relevant provisions of Greek criminal procedure.
Defendants were charged under Article 25 of Law 5038/2023, relating to the unauthorised transport of third-country nationals, with aggravating circumstances such as acting for profit and endangerment of life. Sanctions under this provision include imprisonment of up to 10 years and fines of €30,000–€60,000 per person transported; a minimum of 10 years’ imprisonment and fines of €60,000–€100,000 per person if committed for profit; and a minimum of 15 years’ imprisonment and a fine of €200,000 per person if life is endangered. In addition, all defendants faced charges under Article 83 of Law 3386/2005 for unauthorised entry, which carries a minimum three-month custodial sentence and a fine of at least €1,500.
The first case concerned a defendant who claimed to be a minor. At the previous hearing, in June 2026, the court postponed the proceedings to obtain further evidence, in order to allow for an age assessment to be carried out and for the alleged minor to be transferred to the Closed Controlled Access Centre (CCAC). However, at the subsequent hearing, none of the required actions had taken place.
The second and third cases concerned defendants of Turkish nationality, who were appointed court-appointed lawyers during the hearing. In both cases, both defendants requested a plea deal, resulting in multi-year prison sentences, with ten years to be served in each case.
Legal Representation
First case – Legal representation from the Human Rights Legal Project (HRLP)
In the first case, a lawyer from HRLP was present and demonstrated adequate preparation and knowledge of the case history and procedural issues. The lawyer maintained the position adopted in the court’s previous ruling to adjourn the proceedings to obtain further evidence, in order to allow for an age assessment of the defendant to be carried out. Ultimately, despite the prosecutor’s opposing recommendation, the court upheld its previous decision and adjourned the proceedings once again.
Second and third cases – Same-day appointment of defence counsel from the catalogue
In the second and third cases, defence counsel was state- appointed on the day of the hearing from the relevant catalogue of lawyers. Subsequently, requests for plea deal were submitted on behalf of both defendants. Based on the monitoring of the proceedings, it was not possible to ascertain the nature or content of the communication between the appointed lawyer and the defendants, particularly with regard to whether they had been informed about the plea deal procedure and its consequences.
Duration of Proceedings
The hearing was characterised by successive adjournments and resumptions.
At approximately 10:12, defence counsel was appointed in the second and third cases, and at 10:20 the court adjourned. When the hearing resumed at 11:06, requests for plea bargaining were submitted in both cases, following which the proceedings were adjourned again.
The judgments in the second and third cases were delivered at approximately 14:04. According to the monitoring record, the announcement of both judgments was completed in approximately two minutes.
The brief duration of the announcement does not, in itself, allow any conclusions to be drawn regarding the time devoted to deliberations or judicial assessment. However, the appointment of defence counsel on the day of the hearing and the submission of plea bargaining requests within a short period of time highlight the importance of ensuring adequate preparation time for the defence and that defendants are meaningfully informed.
Claims and Objections
In the first case, the failure to implement the court’s previous decision postponing the hearing, was highlighted by the defence. The case had been postponed to allow for an age assessment to be carried out and for the alleged minor to be transferred to the Closed Controlled Access Centre (CCAC). Despite several months having elapsed since the previous hearing in June 2026, neither of these measures had been implemented. As a result, the question of the defendant’s minority remained unresolved at the subsequent hearing. The failure to carry out the required measures highlighted concerns regarding the timely implementation of judicial decisions and the safeguarding of the specific procedural guarantees provided for persons whose minority has not yet been established.
Prosecutorial Recommendations
In the first case, the Prosecutor questioned the need to maintain the previous decision to postpone the proceedings, despite the fact that neither the age assessment had been completed nor the alleged minor had been transferred to the Closed Controlled Access Centre (CCAC). She raised questions regarding the reasons why the required measures had not been implemented and proposed revoking the previous judicial decision so that the case could be examined on its merits without awaiting the completion of the age assessment procedure.
The Prosecutor’s submission highlighted the distance between the objective of proceeding with the criminal proceedings and the need to establish the defendant’s age beforehand. This issue is crucial in determining the applicable procedural framework and ensuring the specific safeguards provided for minors.
Judgments and Sentences
In the first case, the court did not follow the Prosecutor’s recommendation to revoke its previous decision. Instead, it upheld its decision to postpone the proceedings pending the completion of the necessary steps for the defendant’s age assessment. A new hearing date was expressly set for 28 June 2027. This decision represents a significant development, as the court chose not to proceed with an examination of the merits of the case before the question of the defendant’s age had been clarified.
In the second case, following the same-day appointment of defence counsel from the catalogue of lawyers and the submission of a plea deal request, a sentence of 38 years and 6 months’ imprisonment was announced, with 10 years to be served.
In the third case, following the same-day appointment of defence counsel from the catalogue of lawyers and the submission of a plea deal request, a sentence of 32 years’ imprisonment was announced, with ten years to be served.
The length of the sentences and the use of the plea deals procedure highlight the importance of effective legal assistance and ensuring that defendants are fully informed before making decisions with particularly serious implications for their personal liberty.
General Observations and Conclusions
The monitoring of the three cases highlighted different aspects of the application of fair trial safeguards before the Samos Felony Court of Appeals.
In the first case, the court upheld its previous decision to postpone the proceedings, notwithstanding the Prosecutor’s opposing recommendation, thereby recognising in practice the need to investigate the question of the defendant’s minority before proceeding further.
This approach represents a positive development in terms of safeguarding procedural guarantees. However, the failure to implement the previous judicial decision over a period of several months raises serious concerns regarding the effectiveness of age assessment procedures and coordination among the authorities involved.
In the second and third cases, the appointment of defence counsel during the same hearing and the submission of plea bargaining requests within a short period of time highlight the need to ensure adequate preparation time and appropriate facilities for the defence.
Plea bargaining, particularly where it concerns exceptionally long sentences, requires the defendant to have a substantive understanding of the procedure and its consequences, as well as access to effective legal assistance.
It was not possible, through the monitoring of the hearings, to ascertain the content of the communication between the defence counsel appointed on the day of the hearing and either of the two defendants, or the extent to which they had been informed about the plea bargaining procedure and its legal consequences. Accordingly, no definitive conclusions can be drawn regarding whether the defendants had been adequately informed before submitting the relevant requests.
Nevertheless, the chronological sequence of procedural steps makes further examination of the circumstances in which the plea deal proceedings took place necessary.
Overall, the monitoring of the hearing revealed both a positive practice, namely the decision to maintain the adjournment in order to investigate the defendant’s minority, and significant concerns regarding the implementation of judicial decisions, effective access to justice, and the provision of an effective defence.
Consistent application of Article 6 of the European Convention on Human Rights (ECHR) requires that procedural safeguards be ensured not merely in formal terms, but also in practice, taking into account the individual circumstances of each defendant and their practical ability to participate effectively in the criminal proceedings.
