Greek version below

On 21 October 2026, a trial observer from I Have Rights (IHR), a member organisation of the Border Violence Monitoring Network (BVMN), attended hearings before the Three-Member Court of Appeals for Felonies in Samos, which examined cases at both first and second instance.

The trial observer was present to assess compliance with Article 6 of the European Convention on Human Rights (ECHR) and relevant provisions of Greek criminal procedure, with particular attention to effective legal representation, interpretation, the assessment of evidence, and procedural safeguards for defendants whose minority was in question.

Legal Representation

During the hearing, legal representation was recorded in at least three cases by the Human Rights Legal Project (HRLP), in two cases by privately retained lawyers, and in four cases by defence counsel appointed from the relevant catalogue of lawyers.

The HRLP lawyer demonstrated adequate preparation and knowledge of the cases, submitting relevant documents and case law. Among other arguments, he invoked Article 3 of Law 5038/2023, regarding the exemption of the defendant from criminalisation.

Similarly, privately retained defence counsel demonstrated adequate preparation, presenting specific legal arguments. These included claims based on Articles 25 and 32 of the Greek Criminal Code, as well as an objection alleging absolute nullity of the pre-trial proceedings in one case.

Regarding defence counsel appointed from the catalogue of lawyers, it was not possible, through the monitoring of the hearings, to ascertain whether they had sufficient time to prepare their defence and communicate with the defendants. However, this does not, in itself, allow any definitive conclusions to be drawn regarding the adequacy of legal representation.

Interpretation and Effective Participation

The limited availability of interpreters affected the order in which cases were examined. In some cases, relay interpretation from Arabic into English and subsequently into Greek was used, while in others, Turkish and Farsi interpreters were appointed.

Although these arrangements enabled the proceedings to continue, they highlight the importance of ensuring accurate and complete interpretation, particularly to safeguard defendants' ability to understand and participate effectively in the criminal proceedings.

Duration of Proceedings

The hearing began at approximately 09:03 and was characterised by successive adjournments and resumptions, as well as delays in examining individual cases, primarily due to interpretation-related issues and the need to allow defence counsel appointed during the hearing time to prepare.

Despite these delays, the cases examined were concluded within the same day.

Claims and Objections

In second-instance Case No. 2, the defence invoked the defendant's refugee profile and argued for the application of Article 3 of Law 5038/2023. In second-instance Cases Nos. 3 and 5, the defence raised claims based on a state of necessity under Article 25 of the Greek Criminal Code and, alternatively, Article 32 of the same Code.

In first-instance Case No. 1, the question of the defendant's minority arose, with supporting evidence submitted and the court's jurisdiction examined. In first-instance Case No. 2, the defence denied the charges, raised an objection alleging absolute nullity of the proceedings, and challenged the reliability of witness statements.

Prosecutorial Recommendations

In second-instance Cases Nos. 3 and 5, the Prosecutor recommended rejecting the claims based on a state of necessity, citing insufficient evidence to substantiate the alleged danger or coercion. In Case No. 2, the Prosecutor recommended conviction, disagreeing with the defence's interpretation of Article 3 of Law 5038/2023. In Case No. 7, the Prosecutor agreed with the request to postpone the proceedings.

In first-instance Case No. 2, the Prosecutor recommended rejecting the objection alleging absolute nullity but proposed acquittal due to serious doubts regarding the defendant's guilt. Following the court's decision to convict, the Prosecutor recommended recognising three mitigating circumstances and granting suspensive effect to the appeal, subject to restrictive conditions.

In first-instance Case No. 1, concerning the defendant's alleged minority, the Prosecutor recommended rejecting the defence's claim and proceeding with the examination of the merits of the case before the Three-Member Court of Appeals for Felonies, despite the submission of a birth certificate.

Judgments and Sentences

In the second-instance cases, the court imposed the following sentences, with time spent in pre-trial detention deducted:

Case No. 1: A sentence of 2 years and 3 months' imprisonment, with execution of the sentence suspended.

Case No. 2: A base sentence of 2 years' imprisonment, with an additional year for each of the 29 persons transported. The sentence was set at 10 years to be served and was subsequently converted into a financial penalty, calculated at €10 per day and payable in 24 instalments.

Case No. 3: A sentence of 49 years and 1 month's imprisonment, with 25 years to be served.

Case No. 4: A sentence of 10 years to be served.

Case No. 5: A sentence of 77 years and 2 months' imprisonment, with 10 years to be served.

Case No. 7: The court postponed the proceedings and expressly set a new hearing date in June 2027.

In the first-instance proceedings, in Case No. 1, the court convicted the defendant by majority decision and imposed a sentence of 85 years and 2 months' imprisonment, with 25 years to be served. The court granted suspensive effect to the appeal, subject to restrictive conditions.

In first-instance Case No. 2, concerning the defendant's alleged minority, the court found that it lacked jurisdiction and referred the case to the Three-Member Juvenile Court of Samos, replacing pre-trial detention with restrictive conditions.

General Observations and Conclusions

The monitoring of the hearing on 21 October 2026 revealed numerous convictions and exceptionally long prison sentences, following individualised judicial assessments in the cases examined.

Nevertheless, in one case, the court granted a conversion of the sentence into a financial penalty, while in another, suspensive effect was granted to the appeal subject to restrictive conditions. In a further case, a shorter custodial sentence was imposed, with its execution suspended.

The proceedings also highlighted issues concerning the availability and adequacy of interpretation, as well as successive adjournments and resumptions that affected the duration of the hearing and the order in which cases were examined.

Regarding legal representation, the HRLP lawyer and privately retained defence counsel demonstrated adequate preparation and knowledge of their cases, presenting specific legal arguments and relevant supporting evidence.

By contrast, in cases involving defence counsel appointed from the catalogue of lawyers on the day of the hearing, it was not possible to ascertain whether sufficient time and appropriate facilities had been provided for the preparation of the defence, including the examination of case files and communication with defendants. Accordingly, no definitive conclusions can be drawn regarding the adequacy of preparation or the effectiveness of legal representation in these cases.

Overall, the monitoring highlighted the importance of effective legal assistance, accurate interpretation, individualised judicial assessment, and the practical implementation of fair trial safeguards under Article 6 ECHR, particularly in proceedings involving lengthy custodial sentences and defendants with specific vulnerabilities or international protection-related circumstances.
