The respondents reported that on October 6th, 2020, several groups of people on the move were apprehended in the area close to the Horgoš border crossing around midnight, and later. They described that they were all driven to a police station nearby. It was unclear which one exactly, but likely to be the Horgoš police station due to the short drive.
The groups were reportedly locked together in a room, and people were taken out into another room in pairs by the police officers. According to the respondents, they were then asked how much money they had on them, and then were instructed to give the officers a set amount of money, depending on how much they had at the time.
The officers reportedly threatened the groups with pushing them out of Serbia if they wouldn’t comply with giving them the money. The respondents described that one person told the officers they didn’t have any money, so they ordered him to take all of his clothes off, so they could then search through them.
The second room, where they were taken in pairs, is also the place where the respondents were kicked by the officers. It was reported that everyone in the different groups was kicked, including the five minors present. The respondents described that, as different groups were apprehended at different times, some spent just about an hour at the police station, while others spent approximately 5 hours there. During that time, they were allowed to use the toilet, but didn’t get any food or water. It was reported that pepper spray was used at some point, but it is unclear when.
After the officers took every pair into the second room separately, they handed out a document to each person in the groups. At the time of the testimony, the respondents showed the document that was received by one of the minors, and it stated that "he was caught on the border in track and it's a misdemeanour", but that "because he is a minor, the judge just gave him a warning". The document also states that the minor had an English translator and that a social worker was assigned for him.
According to the law, he should have been assigned a legal guardian and brought to a government-run facility for unaccompanied minors. It is unclear which document the rest of the group received. After handing out the documents, the officers reportedly drove the whole group for approximately 2 hours, leaving them to walk back to the town.
